The EU’s European Securities and Markets Authority is studying initial coin offerings on a “case-by-case basis” to assess whether they should be regulated as securities, Reuters reported.

ESMA Chairman Steven Maijoor wants to figure out which ICOs can be regulated under existing securities rules, and he wants his agency to issue a final report by “the end of the year.”

“Some of these ICOs are like a financial instrument. Once it is a financial instrument it comes under a whole regulatory framework,” Maijoor told the European Parliament’s economic affairs committee. “The subsequent question is what do we do with those ICOs that are outside the regulatory world. We will assess that as a board. We expect to report by the end of the year.”
